Removal of appeal rights for Tier 4 students and their dependants
It was announced today that the UK Immigration Rules will change on Monday 20 October 2014 with the result that any Tier 4 student application (or Tier 4 dependant application) made in the UK on or after Monday will not have a right of appeal if it is subsequently refused. Instead a system of administrative review will be available to Tier 4 applicants and Tier 4 dependants who apply in the UK on or after Monday 20 October 2014 and whose application is refused, or who are granted the wrong length of leave.
This will not apply to any Tier 4 or Tier 4 dependant application made in the UK before 20 October 2014. Any application made before this date that attracts the right of appeal, will still have a right of appeal even if it is refused after 20 October 2014.
Remember, for Tier 4 and dependant applications made in the UK, the date of application is the date on which you submit your application form, and pay the application fee, online.
You should not make a visa application until you are satisfied that you meet all of the requirements. If your application is successful then this change will not affect you as you will not need to challenge the Home Office's decision.
