A is a Romanian national who was self-employed as a care home assistant. She submitted an application to evidence her status in the U.K. The Home Office refused her application stating that she was engaged in disguised employment. We were able to successfully overturn this decision on appeal by showing A was indeed self-employed and someone who was responsible for her own tax and national insurance, that she did not receive sick pay, annual leave or a pension.
